by accessing or purchasing from this website, you agree to the following terms. if you do not agree, do not use this site or purchase our products.
1. general
cool nut tool is a small-batch product designed for recreational use in climbing contexts. it is not a safety device, not load-bearing, and not rated for life-support.
you are responsible for how you use it.
2. assumption of risk
rock climbing and related activities are inherently dangerous. serious injury or death can occur.
by purchasing or using our products, you:
- acknowledge that climbing involves substantial risk
- voluntarily assume all risks associated with use
- accept full responsibility for your actions
you understand that no product can eliminate the risks of climbing.
3. not a life-safety device
cool nut tool products:
- are NOT rated for load-bearing use
- are NOT designed for anchoring
- are NOT personal protective equipment
- are NOT certified under UIAA, CE, or any safety standard
- must never be used to support body weight
improper use may result in serious injury or death.
4. product use disclaimer
you agree to use this product only for its intended purpose: assisting in the removal of passive climbing protection (nuts/stoppers).
you agree never to:
- use it as a load-bearing device
- modify it in a way that affects structural integrity
- use it in a way inconsistent with common climbing practice
you are solely responsible for determining whether the product is appropriate for your intended use.
5. limitation of liability
to the fullest extent permitted by law, cool nut tool and its owner shall not be liable for:
- any direct, indirect, incidental, or consequential damages
- personal injury or death
- property damage
- misuse or modification of the product
- loss of use
your sole remedy for dissatisfaction is return of the product for a refund (subject to return policy).
6. no warranties
products are provided "as is" without warranties of any kind, express or implied, including:
- merchantability
- fitness for a particular purpose
- non-infringement
7. indemnification
you agree to indemnify and hold harmless cool nut tool and its owner from any claims, liabilities, damages, losses, or expenses arising from:
- your use of the product
- your violation of these terms
- any misuse or alteration of the product
8. governing law
these terms are governed by the laws of the state of california, without regard to conflict of law principles.
9. changes to these terms
we may update these terms at any time. continued use of the site constitutes acceptance of the revised terms.
